Texas SB 2610: why a documented security program matters
Texas SB 2610 took effect September 1, 2025, adding Chapter 542 to the Business and Commerce Code. It applies to Texas businesses with fewer than 250 employees that own or license computerized data with sensitive personal information. If such a business shows it implemented and maintained a qualifying cybersecurity program at the time of a breach, the people harmed can't recover exemplary (punitive) damages. Actual damages are still on the table.
What "qualifying" means scales with size:

20-99 employees: moderate requirements, including CIS Controls Implementation Group 1 (IG1)
